This Privacy Policy is effective as of October 20, 2022.

Welcome to BANKCARD INTERNATIONAL GROUP LLC (“B.I.G.”, “we”, “us” or “our”). Our Privacy Policy explains how we collect, use, share, and protect information in relation to the use of our company website, mobile site, or mobile device applications (collectively, the “Sites”), and the merchant credit card processing services and other products (“Services”) offered by B.I.G. to its clients. The Sites and Services are sometimes referred to collectively herein as the “Platform.” Establishing an effective Privacy Policy, designed to protect your information and provide you with choices on how you would like your information managed, is an important part of our relationship with you.

Additional details about our use of Clients’ information can be found in the Terms of Use documenting your relationship with B.I.G. and its Services.    

PERSONAL AND OTHER INFORMATION WE COLLECT

In General. Through your interaction with and use of the Platform, including for the purpose of uploading information, request for services, company information related to any merchant processing services application, and other materials and content (through online forms, cookies, widgets, log files and clear gifs) (“User Content”), B.I.G. may collect “Personal Information,” which is information that directly or indirectly identifies an individual or which relates to an identifiable individual. Personal Information does not include anonymized information or aggregated data about a group or category of Services, features, or users which does not contain personally identifying information and which helps us better understand our Clients’ needs and improve our Services.

Information you provide. We may collect and store any Personal Information you enter on Sites or provide to us when registering for an account or paying for our Services. This includes identifying information such as your name, address, e-mail address, social security number or EIN telephone number, and credit card number, credit information, credit card/bank information, IP address, type of web browser used or other financial information. We also may request other demographic information. We may occasionally ask for your feedback via a survey in order to improve our Services and Platform. Your participation in these surveys is completely voluntary.

Information from other sources. We may also periodically obtain both Personal Information and non-Personal Information about you from other business partners, contractors, and other third parties. Examples of information that we may receive include (but are not limited to): updated contact and address information, order history, and information from third-party service providers such as LinkedIn, Facebook or Instagram with whom your account may be connected. Please note that these third-party service providers have different privacy policies and practices that are not subject to this Privacy Policy.

Use of Cookies and Other Technologies. We use various technologies to collect information from your computer and about your activities on our Platform.

Information collected automatically. We automatically collect information from your browser when you visit our Sites and use our Services. This information includes your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us (see “Cookies” below), and the referring website address.

Registration. For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Cookies. When you visit our Sites, we may assign your computer one or more cookies to facilitate access to our Sites and to personalize your online experience. A cookie is a small text file that is stored on a user’s computer for recordkeeping purposes. Through the use of a cookie, we also may automatically collect information about your online activity on our Sites, such as the web pages you visit, the links you click, and the searches you conduct on our Sites. Most browsers automatically accept cookies, but you can usually modify your browser setting to delete or decline cookies. If you choose to decline cookies, please note that you may not be able to sign in or use some of the interactive features offered on our Sites as it relates to the Services we sell or for access to any blogs.

Widgets. Widgets are interactive mini-programs that run on our site to provide specific services from another company (e.g., links to bookmarked sites), along with buttons or other tools that link to other companies’ services (e.g., a “Like” button or third-party map). The widget, button or tool may collect and automatically send Personal Information, such as a User’s e-mail address, or other information (such as a User’s browser information, or IP address), to a third party. Information collected or used by a widget, button, or tool, including cookie settings and preferences, are governed by and subject to the privacy policy of the company that created it.

Other technologies. We may use standard Internet technology, such as web beacons and other similar technologies, to track your use of our Platform. We also may include web beacons (also known as clear gifs, pixel tags, or web bugs) in promotional or other e-mail messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize the Services we offer our website visitors to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming, or other activities.

HOW WE USE AND SHARE INFORMATION

Except as described in this Privacy Policy, B.I.G. will not rent, sell, or provide your Personal Information to any third party. B.I.G. uses and shares the Personal Information it collects (unless otherwise restricted by applicable law), to:

Process Transactions and Accept Payments. Users of our Sites, purchasers of our Services and others engaging in transactions with us may be asked to provide additional information including, as necessary, the personal and financial information required to process those transactions. In each case, B.I.G. collects such information only insofar as is necessary or appropriate to fulfill the purpose of the Client’s interaction with B.I.G..

Perform Services and Provide Support. B.I.G. may use Personal Information to perform certain services, personalize Services and related ancillary products related content, manage your account and provide you with Client support, such as software updates and resolving bugs.   B.I.G. may also use Personal Information to enforce our Terms of Use, manage our business, and perform functions as otherwise described to you at the time of collection.

Tailor Marketing to the Client’s Needs and Respond to the Client’s Requests. B.I.G. may use your Personal Information to notify you about new Service related offerings, merchant processing services related content and blogs, and to advertise our Services in accordance with this Privacy Policy. In addition, if the client consents, B.I.G. may share a client’s Personal Information with other selected third-party partners that offer complementary products or Services. Please review the specific third-party partner’s privacy policy regarding any further interactions with them.

Obtain Third Party Services. We also share Personal Information with third parties who provide services or products to B.I.G. such as credit card processing services, merchant processing equipment, analytics, website management, information technology and related infrastructure provision, Client service, e-mail delivery, auditing, and other similar services. When B.I.G. shares Personal Information with third-party service providers, we require that they use the client’s Personal Information only for the purpose of providing Services to us and subject to terms consistent with this Privacy Policy.

Comply with Legal Requirements and Corporate Transactions. B.I.G. may access, preserve, and share Personal Information in response to a legal request (like a search warrant, court order, or subpoena) if we have a good faith belief that the law requires us to do so or when B.I.G. believes in good faith that disclosure is reasonably necessary to protect the property or rights of B.I.G., third parties, or the public at large. We may also access, preserve, and share Personal Information when we have a good faith belief it is necessary to: detect, prevent, and address fraud and other illegal activity; to protect ourselves, you, and others, including as part of investigations; and to prevent death or imminent bodily harm.

Additionally, in the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or equity (including in connection with any bankruptcy or similar proceedings), we may transfer the Personal Information we have collected to the relevant third party.

Job Postings. If your Personal Information is submitted through our website when applying for a position with our company, the information will be used solely in connection with considering and acting upon your application. We may retain your Personal Information for a period of time, but only for the purpose of considering your application for current or future available positions, or as required by law. This information may be shared with third-party service providers retained by us to collect, maintain, and analyze candidate submissions for job postings.

Some of the Personal Information uses specified above are not mandatory and may be controlled by you. Please refer to the “Privacy Choices” section below for information on available preferences or opt-out options.

At a minimum, B.I.G. safeguards for the protection of Personal Information will include: (i) limiting access of Personal Information to Authorized Employees and Authorized Persons; (ii) securing business facilities, data centers, paper files, servers, back-up systems and computing equipment including, but not limited to, all mobile devices and other equipment with information storage capability; (iii) implementing network, device application, database and platform security; (iv) securing information transmission, storage and disposal; (v) implementing authentication and access controls within media, applications, operating systems and equipment; (vi) strictly segregating Personal Information from information of B.I.G. or its other customers so that Personal Information is not commingled with any other types of information; (vii) implementing appropriate personnel security and integrity procedures and practices including, but not limited to, conducting background checks consistent with applicable law; and (viii) providing appropriate privacy and information security training to B.I.G.’ employees.

PRIVACY CHOICES

You may update your B.I.G. account at any time by logging in and changing your profile settings. You may unsubscribe from email communications from us by clicking on the “unsubscribe link” provided in such communications. You may not opt out of service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the services, technical and security notices). Following termination or deactivation of your account, B.I.G. may retain information (including your profile information) and User Content for a commercially reasonable time for backup, archival, and/or audit purposes.

As noted above, Site visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using B.I.G.’s websites, with the drawback that certain features of our Platform may not function properly without the aid of cookies.

OTHER WEBSITES AND SERVICES

We are not responsible for the practices employed by any websites or other products or services linked to or from our Sites, including the information or content contained within them. Please remember that when you use a link to go from our website to another website, our Privacy Policy does not apply to those third-party websites or the products and services offered on those websites. Your browsing and interaction on any third-party website, including those that have a link on our website, are subject to that third party’s own rules and policies.

SECURITY

The security of your Personal Information is very important to B.I.G. We use physical, electronic, and administrative safeguards that are designed to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. In addition, B.I.G. uses standard security protocols and access control mechanisms to exchange the transmission of sensitive data such as credit card and banking details. We cannot, however, guarantee the confidentiality or security of your browser or any unencrypted communication transmitted or accessible over the Internet. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.

State and Federal Law. B.I.G. represents and warrants that its collection, access, use, storage, disposal and disclosure of Personal Information does and will comply with all applicable federal and state privacy and data protection laws, as well as all other applicable regulations and directives, provided that Client specifically acknowledges and agrees that B.I.G. is not acting on your behalf as a business associate or subcontractor.  

B.I.G. does not represent, warrant, or guarantee that Personal Information will be protected against unauthorized access, loss, misuse, or alterations. Similarly, B.I.G. disclaims liability for Personal Information and User Content submitted through its Platform. In the event that your Personal Information is acquired, or you or B.I.G. reasonably believes that your Personal Information has been acquired, by an unauthorized person and applicable law requires notification, B.I.G. will promptly notify you by e-mail, fax, or U.S. mail, consistent with the reasonable needs of law enforcement and/or B.I.G. in order to determine the scope of the breach and to investigate and restore the integrity of the data system.

Security Breach Procedures. B.I.G. will inform Client within fourteen (14) business days if B.I.G. determines that Client Information has been subject to a Security Breach. Notification shall be made by telephone, mail, or email to B.I.G.’s primary business contact with Client. B.I.G. will promptly investigate any Security Breach and take reasonable measures to identify its root cause(s) and prevent a recurrence. As information is collected or otherwise becomes available, B.I.G. will provide Client with a description of the Security Breach, the type of data that was the subject of the Security Breach, and other information Client may reasonably request concerning the affected persons. B.I.G. will coordinate in good faith with Client to develop the content of any related public statements or any required notices for the affected persons.

CHILDREN’S PRIVACY

The B.I.G. Platform is not directed at children under the age of 18 nor is it directed at consumers. By using the Platform, you acknowledge that any User Content or other information provided to B.I.G. that contains the Personal Information of children is provided solely by, and with the full consent of, the parent or guardian. B.I.G. does not knowingly collect or solicit any information from anyone under the age of 18 or knowingly allow such persons to register for the Sites or Services. In the event that we learn that we have collected Personal Information from a child under age 18 without parental consent, we will delete that information as quickly as reasonably possible.

PRIVACY POLICY CHANGES

Although most changes are likely to be minor, B.I.G. may change its Privacy Policy from time to time, in our sole discretion. B.I.G. encourages Clients and other users to frequently check this page for any changes to its Privacy Policy. If you have an account with B.I.G., you should also check your account’s notifications for alerts to these changes. Your continued use of the Platform after any change in this Privacy Policy will constitute your acceptance of such changes.

California Residents. California Residents Under California Civil Code Section 1798.83 (also known as S.B. 27), if a Client/User is a California resident and the Client/User’s business relationship with B.I.G. is primarily for personal, family, or household purposes, the Client/User may request certain data regarding B.I.G.’s disclosure, if any, of Personal Information to third parties for the third-party’s direct marketing purposes. To make such a request, please fill out an inquiry form; the Client/User may make such a request up to once per calendar year. If applicable, we will provide you, by e-mail, a list of the categories of Personal Information disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, along with the third parties’ names and addresses. Please note that not all Personal Information sharing is covered by S.B. 27’s requirements.

Choice of Law. This Privacy Policy shall be subject to and governed by the laws of the state of Washington. Any dispute, controversy, or claim arising out of or in connection with or relating to this Privacy Policy or any breach or alleged breach hereof, will, upon the request of any party involved, be submitted to, and settled by, arbitration in Vancouver, Washington, pursuant to the American Arbitration Association rules of arbitration. Any award rendered shall be final and conclusive upon the parties and a judgment thereon may be entered in the highest court of the forum, state or federal, having jurisdiction. In the event that neither party requests Arbitration, each Client hereby consents to the exclusive jurisdiction of Clark County, Washington, Superior Court in any action on a claim arising hereunder.
